RHOSLC star Monica Garcia’s lawsuit against Heather Gay’s Beauty Lab dismissed after she accuses brand of ‘botched’ job

REAL Housewives of Salt Lake City's Monica Garcia's lawsuit against Heather Gay's company Beauty Lab has been dismissed, The U.S. Sun can exclusively reveal.

Monica, 39, filed a counterclaim lawsuit against Beauty Lab + Laser a few months ago after the medical spa sued the reality star for not paying off her alleged $2,000 debt.

Monica claimed Beauty Lab performed a "defective lip plumping procedure" on her, similar to a Botox injection.

Now, in a new court filing exclusively obtained by The U.S. Sun, a Utah judge has officially dismissed Monica's lawsuit on January 17.

After reviewing all corresponding pleadings, the court dismissed her case since her claim is "time barred by the statute of limitations" and Monica "failed to obtain a certificate of compliance from the Division of Professional Licensing."

The court further stated that a hearing on the motion would not be helpful since the "the law is clear and straightforward in this matter."

However, Heather Gay's company's lawsuit against Monica is still active.

The U.S. Sun has reached out to Monica's attorney for comment.

BEAUTY LAB SCORES

At this point in the ongoing court battle, it appears Beauty Lab has the upper hand, especially after leaking DMs and having filed a Motion to Dismiss the Brea Baby founder's counterclaim in November.

The brand is not backing down until Monica pays the $2,000 she owes for beauty services she got done on her nose and lips, plus pre and post judgment interests, costs and attorney's fees.

Monica was seen on or around October 10, 2019, and January 6, 2020.

The Salt Lake City spa fought with the court to dismiss her lawsuit on two separate grounds - one of them being that the TV personality did not initiate her claim until September 2023.

"First, the Utah Health Care Malpractice Act, which governs [Monica's] claims, imposes a two-year statute of limitations on all malpractice actions against a health care provider," the court doc stated.

"Consequently, [Monica's] claims against BLL are time-barred by the Act's statute of limitations and should be dismissed with prejudice."

The second argument they make is that the court "lacks subject matter jurisdiction," meaning she "did not obtain a Certificate of Compliance or follow any of the prelitigation requirements set forth in the Act prior to filing this lawsuit."

MONICA WON'T GIVE UP

Prior to the court dismissing her lawsuit, Monica held depositions with two aestheticians at the other company that allegedly corrected her "botched" lip injections.

The depositions were held on January 12, 2024, at RUMA Aesthetics and recorded for attorney and court use.

The documents that were to be produced at the time were "copies of all records of procedures by RUMA Aesthetics," including any photographs taken of Monica from January 1, 2019 to March 30, 2019.

However, after attempting to seek the recordings, The U.S. Sun was made aware by the court that the depositions are private and can't be released.

PROTECTION ORDER

On January 15, 2024, Monica had filed a Motion for Protective Order to essentially not have to disclose private information that is unrelated to the case.

She requested the following be left out of the case: her health care providers, her Medicare health insurance information, her employers from the past five years prior to the date of service, copies of bills and statements, investigative reports and so forth.

She requested that the court grant this for various reasons, such as she was never treated by a health care provider to correct the "defective cosmetic lip plumping procedure," there are no investigative reports and she doesn't claim lost of wages due to this.

The court has yet to rule on the Motion for Protective Order.

BIG BLOWOUT

Monica and Heather had not brought up their nasty court battle until part two of the RHOSLC Reunion, which aired on January 16.

Following an argument with co-star Angie Katsanevas, Monica got caught in a lie after she said she never sued anybody.

The Beauty Lab lawsuit was then brought up, and Monica said that she sued because Heather was suing her.

Angie screamed: "Why is it bad? Pay your f**king bill."

Monica fired back, "God damn. No!"

While both ladies were talking over one another, Heather chimed in saying that she was "doing it for collections."

It had not been revealed that her lawsuit was dismissed since filming for the reunion took place prior to the dismissal.

The drama between the co-stars continues when part three of the RHOSLC Reunion airs on January 23.
